1. Acceptance of Terms
These Terms of Use ("Terms") form a binding agreement between you and Caracas Luxury Estate ("we", "us"). Use of caracasluxuryestate.com and any related materials constitutes acceptance of these Terms in full.
2. Nature of the Listing
This website presents a single private residential property in La Trinidad, Caracas, Venezuela, offered to qualified buyers under strict confidentiality. The site is informational and does not constitute an offer for sale, a public solicitation, or a binding contract.
All transactions are subject to: (i) execution of a Non-Disclosure Agreement; (ii) buyer qualification; (iii) due diligence; and (iv) a fully executed purchase agreement under Venezuelan and applicable international law.
3. No Warranties
Information on this site, including dimensions, finishes, amenities, photographs, and pricing references, is provided in good faith but without warranty of any kind. Square footage, room counts, taxes, and condition representations must be independently verified by the buyer's advisors prior to closing.
Photographs may be taken at different dates and may not reflect the current state of the property in every respect.
4. Confidentiality
The dossier, floor plans, security disclosures, financial information, and any other materials provided to qualified buyers are confidential. By requesting these materials you agree:
- Not to redistribute, publish, or post them on any third-party site.
- To use them solely to evaluate a potential acquisition for your own account.
- To return or destroy all materials upon written request.
Breach of confidentiality may result in legal action and damages.
5. Buyer Qualification & Compliance
Showings and detailed information are reserved for buyers who can demonstrate, to our reasonable satisfaction, the financial capacity to complete the transaction. We comply with applicable anti-money-laundering (AML), counter-terrorism-financing (CFT), and sanctions regulations and may decline to engage with any party that does not meet these standards.
6. Intellectual Property
All content on this site — including text, photographs, video, layouts, the "Caracas Luxury Estate" name, and the visual identity — is the exclusive property of the ownership or its licensors and is protected by copyright and trademark law. No content may be reproduced, modified, or distributed without prior written consent.
7. Acceptable Use
- You may not attempt to reverse-engineer, scrape, or systematically extract data from this site.
- You may not submit false information through any form.
- You may not use the site to transmit malicious code or to attempt to compromise its security.
8. Third-Party Services
The site relies on third-party providers (Vercel for hosting, Resend for email delivery, Zoho for correspondence). Their use is governed by their own terms and privacy policies. We are not responsible for actions or outages of third-party services beyond our reasonable control.
9. Limitation of Liability
To the maximum extent permitted by law, Caracas Luxury Estate, its representatives, advisors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the site or reliance on its information. Direct liability is limited, in any event, to one hundred U.S. dollars (USD 100).
10. Indemnification
You agree to indemnify and hold harmless Caracas Luxury Estate from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of confidential materials.
11. Governing Law & Venue
These Terms are governed by the laws of the Bolivarian Republic of Venezuela, without regard to conflict-of-law rules. Any dispute that cannot be resolved amicably will be submitted to the exclusive jurisdiction of the competent courts of the Metropolitan Area of Caracas, unless the parties mutually agree to international arbitration.
12. Changes
We may update these Terms at any time. Continued use of the site after publication constitutes acceptance of the updated Terms.
